A federal judge has overturned Illinois’ ban on semiautomatic weapons, leaning on recent U.S. Supreme Court rulings that strictly interpret the Second Amendment right to keep and bear firearms.

Officials in the state have already filed an appeal after the Trump-appointed judge’s ruling, which cites recent Supreme Court decisions on the Second Amendment.

The ban was signed into law in January 2023 and prohibited the sale or transfer of assault rifles and high-capacity magazines in Illinois.

A downstate federal judge on Friday ruled that Illinois’ sweeping gun ban is unconstitutional and can no longer be enforced after 30 days. The ruling comes nearly two years after the ban on certain high-powered guns and high-capacity magazines was signed into law by Gov.

The decision comes as a federal appeals court in the state last month upheld the assault weapon ban — which was passed last year following a mass shooting at a Fourth of July parade in the suburbs of Chicago — arguing that the ban constitutes a reasonable limit on the Second Amendment.
